Shirt Shark Policies and Website Terms
and Conditions
1) Shirt Shark reserves the right to change or alter the terms
of any special offer, service offerings or pricing structures without
prior notice.
2) Free graphic design is defined as work performed resulting in
an illustration or graphic work. Free graphic design does not include
ownership of artwork.
3) Artwork or graphics resulting from free graphic design are licensed
to a customer for use on T-shirts or other apparel. All graphics
provided by Shirt Shark must be printed by Shirt Shark.
4) Free graphic design services are provided "as is"
with no obligation to meet any artistic criteria, style of expression,
or skill level.
5) No time sheets or other records of hours worked will be provided
for free graphic design.
6) Shirt Shark may, in its sole and absolute discretion, count
all forms of consultation, creative revisions or other tasks relating
to the creation of artwork as part of the process of graphic design.
7) Shirt Shark may, in its sole and absolute discretion, choose
to create either digital artwork using a computer, traditional artwork
or a combination thereof.
8) Shirt Shark does not provide any original graphic files or high
resolution images for free graphic design services. Graphic artwork
may be purchased or licensed under a separate agreement.
9) Free graphic design services are limited to the resources currently
available to Shirt Shark. There is no obligation for Shirt Shark
to use specific software, equipment or other art supplies not available
to Shirt Shark.
10) Shirt Shark does not offer pro-rated services or pricing structures
under any circumstances.
11) Free graphic design services are available to qualified customers
only. No other offers, coupons or discounts can be used in conjunction
our free graphic design offer.
12) Shirt Shark will not print, design, manufacture, or produce
a shirt or other imprinted item that infringes the rights of a third
party, including, without limitation, copyrights, trademarks, patents,
trade secrets, rights of privacy and publicity.
13) Shirt Shark retains complete ownership of all original artwork
creations. Customers are not allowed to use artwork in any medium
or format, including on shirts or apparel, without prior permission.
14) In its sole and absolute discretion, with or without prior
notice, Shirt Shark may refuse to print, design, manufacture, or
produce an imprinted item or other product that is (i) libelous,
defamatory or slanderous, (ii) condones, promotes, contains or links
to warez, cracks, hacks or similar utilities or programs, (iii)
is sexually suggestive or contains explicitly sexual content (including
nudity), (iv) does or may denigrate or offend any ethnic, racial,
gender, religious or other protected group, through use of language,
images, stereotypical depiction or otherwise, (v) is designed to
or does harass, threaten, defame or abuse others, (vi) exploits
images or the likeness of minors, (vii) encourages or depicts the
use of drugs, alcohol or cigarettes or (viii) is generally offensive
or in bad taste.
15) SHIRT SHARK WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR
ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE OR SPECIAL DAMAGES
(INCLUDING DAMAGES RELATING TO LOST PROFITS, LOST DATA OR LOSS OF
GOODWILL) ARISING OUT OF, RELATING TO OR CONNECTED WITH THE USE
OF SHIRT SHARK SERVICE OR PRODUCTS, BASED ON ANY CAUSE OF ACTION,
EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Shirt Shark Return Policy:
Shirt Shark offers a Satisfaction Guarantee and aims to make our
customers happy with their order. We offer a no hassle, no questions
asked return policy. Customers can return a
full custom printed order within 15 days of purchase. Simply return
the t-shirts with the original paperwork and packaging within 15
days of receiving your order. Please contact us regarding
any returns. You can call or email us at Email
Customer Service and we will provide the information you will
need to process the return.
All returns must be referenced by an invoice number. There will
be a 20% restocking fee. No return will be accepted on used or washed
merchandise. T-shirts must be in new, unworn condition. Partial
returns are not accepted. We do not refund any shipping costs. We
recommend sending the returned merchandise via UPS or Parcel Post.
Insurance is recommended to cover any loss or damage by the carrier.
Terms of Service for Credit Card Purchases:
The term "credit card holder" as used in these terms
and conditions is defined as the person or entity in whose name
the credit card was issued by the bank or financial institution
that appears on the credit card.
When you complete a purchase from our online store using a credit
card for payment, you agree to the following terms and conditions:
You are the credit card holder, a representative of the credit
card holder or the credit card holder is aware you are making the
purchase and has authorized you in advance to make the purchase
using their credit card.
If you are not the credit card holder, you agree to notify the
credit card holder of the purchase before making the purchase, and
you guarantee to ShirtShark, Inc. that you have made the credit card
holder aware of the purchase in advance.
Should you have a problem with your purchase, you will contact
ShirtShark, Inc. to allow us to resolve the problem before contacting
either the financial institution that issued the credit card or
the credit card company.
Credit Card Chargeback Policy:
You can rest assured that our credit card processing is completely
secure. After you place your order, you will receive an automated
receipt via email. We urge you to keep a copy of your email order
receipt for your records. When you receive your credit card statement
(if you ordered by credit card), you will see a charge from ShirtShark.
Should you forget and question or challenge this charge with your
credit card company, we, as an Internet merchant, are assessed a
$25 chargeback fee which is non-refundable. Additionally the entire
cost of your order is deducted from our account. That money is not
returned to us for 90 days following the resolution of the charge.
The $25 chargeback fee is NEVER refunded to us - even after we provide
proof of a valid charge. Therefore, we must pass this $25 fee back
to you if you challenge a valid charge.
Your satisfaction is our primary goal. We encourage you to contact
us for any issue with your purchase before considering a chargeback.
We have an excellent track record in making sure our customers are
fully satisfied with their purchases. If you have any concerns about
your purchase we encourage you to contact us. We are always happy
to assist you when needed.
All references to "chargeback" refer to a reversal of
a Visa or MasterCard credit card charge placed at one of our ShirtShark
Powered Stores. Fraudulent chargeback's are considered theft and
can be prosecuted. If you feel that your credit card was used fraudulently
at one of our stores, please contact us for immediate resolution.
You agree that you will not chargeback any valid amounts charged
to your credit card by Style Star. If you chargeback a credit card
charge for a valid payment initiated by you, you agree that ShirtShark
may recover the amount of the chargeback in addition to $25 by any
means deemed necessary, including but not limited to recharging
your credit card or having the amount recovered by a collection
agency.
To request a chargeback on your credit card for a valid transaction
is considered FRAUD. Fraudulent credit card chargebacks will be
aggressively PROSECUTED. We work closely with the Anti-Fraud Coalition,
which is a partnership with the FBI to stop this kind of FRAUD.
We will notify the appropriate Federal, State, and Local officials.
Fraud is a FELONY. Committing a felony is a serious offense, and
there are people CURRENTLY SERVING TIME IN JAIL FOR CHARGING BACK
VALID TRANSACTIONS ON THEIR CREDIT CARDS. We report all wrongful
or fraudulent chargebacks to Chargebackbureau.org.
